Saeid Fasihi appointed commercial judge at district court Frankenthal

At the suggestion of the Chamber of Commerce and Industry for the Palatinate, our CEO Saeid Fasihi has been appointed honorary commercial judge to the Chamber for Commercial Matters at the district court of Frankenthal for a period of five years. "I am very pleased about the nomination and trust placed in me," said Fasihi.

"I am very pleased about the nomination and trust placed in me," said Fasihi. 

In his role as a commercial judge, Saeid Fasihi is obliged to observe strict neutrality. He participates in trials with equal rights as his colleagues being professional judges. Unlike jurors, commercial judges do not act as lay judges, but act on the basis of their own job-related qualification as an independent, proficient expert judge. Legislators take account of this fact by considering any nominations for commercial judges only at the suggestion of the Chamber of Commerce and Industry, and they cannot merely be appointed by the Justice Department of the respective federal state alone.

At the Chamber for Commercial Matters at the district court of Frankenthal, general trading operations, proceedings involving bills of exchange, cheques and documents, competition law as well as matters regarding the commercial registry are dealt with on plaintiffs or defendants' requests. The subject-matter jurisdiction exists, in accordance with the status of the district courts, when pecuniary disputes involve  high litigation values (at present more than 5,000 euros).

Chambers for Commercial Matters consist of a professional judge presiding the trial and of two honorary commercial judges. There exists a statutorily guaranteed equality among all three judges, so that each judge has a vote. The judicial expertise of the professional judge and the commercial expertise of both commercial judges make it possible to reach practical and appropriate verdicts.
